As of July 26, 2024, New Hampshire enacted House Bill 185, establishing a rebuttable presumption that approximately equal parenting time between fit, willing, and able parents is in the best interests of the child. This means courts begin custody decisions with the assumption that both parents should share custody equally. However, this presumption can be challenged with evidence demonstrating that equal parenting time may not be suitable in specific cases.
