As of April 2021, Arkansas law establishes a rebuttable presumption of joint custody, defined as equal parenting time, in child custody cases. This means that courts begin with the assumption that both fit, willing, and able parents should share custody equally. To deviate from this presumption, clear and convincing evidence must be presented demonstrating that equal parenting time is not in the child's best interests.
